Rear-End Accident Lawyer in Springfield
Focused Representation After an Impact from Behind
A rear-end collision can cause significant injuries even at low speeds. At Bishop & Hayes P.C., our rear-end accident attorneys in Springfield focus exclusively on personal injuries involving car, truck, motorcycle, and pedestrian accidents. That focus grounds our work in the evidence and insurance issues that shape auto injury claims.
Whiplash, caused by the rapid back-and-forth movement of the neck, is common after an impact from behind. It and other injuries may interfere with work, daily activities, and family responsibilities. A medical evaluation can address injuries that aren’t immediately apparent and document their connection to the crash.
We’ve recovered more than $100,000,000 for clients in auto accident cases. Brad Bishop’s previous insurance defense work also gives us direct insight into how insurers assess injuries, dispute fault, and value claims.

Fault in a Missouri Rear-End Collision
Missouri Revised Statutes Section 304.017 requires motorists to maintain a reasonably safe following distance. A driver who hits the back of another vehicle may be presumed responsible because the impact can indicate that the driver followed too closely or failed to stop safely. Rear-driver fault isn’t automatic, however, and the available evidence must be considered.
A defective brake light, an unsafe merge by the lead driver, or another unusual event may affect the analysis. Vehicle positions, traffic conditions, points of impact, and each driver’s actions can also influence the determination. We examine all the facts rather than relying only on the location of the vehicle damage.
How Missouri Pure Comparative Fault Affects Compensation
Missouri follows pure comparative fault, which allows responsibility for a collision to be divided among those involved. Under Missouri’s comparative fault doctrine, an injured claimant’s compensatory damages are reduced by that person’s percentage of fault.
For example, a claimant found 20% responsible would have compensatory damages reduced by 20%. A claimant can still recover damages when assigned more than 50% of the responsibility, although the reduction may be substantial. An insurer may argue that the lead driver contributed to the crash, making evidence about braking, signaling, lane changes, and traffic conditions important.
Evidence After a Springfield Rear-End Accident
Your first priorities after a crash are safety and medical attention. Confirm that everyone is safe, call 911, exchange contact and insurance information, document the scene, seek medical care, and contact our firm.
When it’s safe to do so, useful documentation may include:
- Photographs of vehicle damage, visible injuries, the roadway, and traffic controls
- The police report identifying the drivers and recording information gathered at the scene
- Witness names and statements describing how the collision occurred
- Medical records connecting reported symptoms, evaluations, and treatment to the crash
Some vehicles record electronic data about their operation before an impact. Whether that information is available and relevant depends on the vehicles and circumstances. Early preservation matters because vehicles may be repaired, physical marks can disappear, and witnesses’ memories may fade.
When appropriate, we work with investigators, medical professionals, and accident reconstruction professionals to support an injury claim. Their work may document collision mechanics, evaluate medical issues, or analyze disputed accounts without treating any single piece of evidence as a legal conclusion.

Compensation in a Rear-End Collision Claim
Available compensation depends on the injuries, medical treatment, effect on employment, property loss, insurance coverage, and supporting evidence. We pursue applicable damages based on how the collision has affected the injured person and their family.
A car accident claim may include compensation for:
- Medical expenses related to collision injuries
- Lost income and reduced earning potential
- Vehicle damage and other property loss
- Pain and suffering
- Loss of enjoyment of life
- Loss of consortium affecting a marital relationship
Missouri Filing Deadlines
Missouri Revised Statutes Section 516.120 generally provides five years from the accident date to file personal injury and property damage lawsuits arising from a car accident. A wrongful death claim arising from a Missouri collision generally must be filed within three years of the date of death.
The applicable statute of limitations, or legal deadline for filing a lawsuit, can depend on the claim and its specific facts. Even when the deadline hasn’t expired, waiting can make evidence harder to locate.
Partner-Led Rear-End Accident Representation
Our partners handle cases from the initial consultation through recovery rather than transferring responsibility to less experienced staff. Clients have consistent access to the attorneys making decisions about evidence, negotiations, and litigation.
We take proactive steps as a claim develops and prepare to negotiate with insurers or litigate when needed. We also return client phone calls and emails the same day, keeping clients informed as they manage medical care and other consequences of the collision.
